Court Victory That Protects the Federal Government’s Ability to Regulate Plastic Pollution

After more than three years of legal challenges, the Federal Court of Appeal affirmed the federal government’s authority to list plastic manufactured items as toxic under the Canadian Environmental Protection Act. This decision restores the federal government’s ability to regulate plastic pollution nationwide. It also allows long-delayed measures — including recycled content requirements and pollution prevention plans for major grocers — to move forward.
